Our firm handles most residential and commercial real estate closings. A closing is the process of executing legally binding documents, such as deeds and mortgages most commonly associated with the purchase of real estate and the borrowing of money to assist in the purchase. The process also includes examining the title, securing title insurance, if needed, and coordinating the closing. We have the experience necessary to provide superior service. 

To learn more about what you need to do as a client to make your real estate transaction go as smooth as possible please review the documents below:

  • Closing Checklist for the Buyer
  • Prior to Closing, we will need the following items from you:

    1. Your Homeowners/Hazard Insurance policy information

    2. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the Buyer/Borrower.

    Please bring the following to the Closing:

    1. Photo identification (Please Note: the name on the I.D. must match the name on the Closing documents)

    2. Funds for Closing in the amount shown on your preliminary HUD-1 Settlement Statement or Lender's Good Faith Estimate if no preliminary HUD-1 Settlement Statement is available. (Please Note: funds must be in the form of either a Cashier's Check, Wired or Certified Funds or funds drawn on a South Carolina Attorney's Trust Account).

    3. Your personal checkbook to cover any last minute adjustments to the HUD-1 Settlement Statement at Closing

    4. Copy of the Declaration Page of your Homeowner’s/Hazard Insurance policy.

    5. If a Power of Attorney is to be used, and has been prepared or approved by our Office, the Original Executed Power of Attorney
    (Please Note: the original Power of Attorney must be retained by Starkes Law Firm, L.L.C. after the Closing for the purpose of recording if applicable)

  • Closing Checklist for the Seller
  • Prior to Closing, we will need from you:

    1. Names of all parties on the title to the property

    2. Homeowners Association contact information, including contact name, address and telephone number.

    3. All payoff information, including contact information for each loan, account numbers and Social Security numbers for all parties on the loan. We will also need a signed written authorization to obtain your payoffs.

    4. Copies of invoices for any repairs that are to be paid from closing proceeds.

    5. Copy of the Termite Letter.

    6. Your forwarding address, social security number and telephone number.

    7. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the Seller.

    Please bring the following to your Closing:

    1. Photo identification for all parties on Title (Please Note: the name on I.D. must match the name on the Title to the Property).

    2. The Original Termite Letter.

    3. Any Home Warranty information, if applicable.

    4. Copies of invoices for any repairs, if applicable.

    5. Keys and/or garage door openers to the property.

    6. If a Power of Attorney is to be used, and has been prepared or approved by our Office, the Original executed Power of Attorney (Please Note: the original Power of Attorney must be retained by Starkes Law Firm, L.L.C. after the Closing in order to record title and other documents)

  • Closing Checklist for the Realtor
  • Prior to Closing, we will need from you:

    1. A Copy of a signed contract, including any and all addendums.

    2. Contact information for the Buyers and Sellers.

    3. Name and contact information for the Mortgage Lender or Mortgage Broker.

    4. Homeowners Association contact information, including contact name, address and telephone number.

    5. A Copy of the Termite Letter.

    6. All payoff information for the Seller, including contact information for each loan, account numbers and Social Security numbers for all parties on the loan and a signed authorization to obtain payoffs.

    7. Whether a survey will be required or not.

    8. Any Home Warranty Information, if applicable.

    9. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the parties.

    Please bring the following to your Closing:

    1. An original signed contract including any and all addendums.

    2. Any Home Warranty information, if applicable.

    3. Copies of any invoices for any repairs, if applicable.

    4. The Original Termite Letter.

  • Closing Checklist for the Builder
  • Prior to Closing, we will need from you:

    1. Names of all parties on the title to the Property.

    2. Homeowners Association contact information, including contact name, address, and telephone number.

    3. Payoff information including loan numbers, phone numbers and points of contact. A signed letter of authorization to obtain payoffs.

    4. Copies of any relevant Corporate Resolution Documents showing who can sign at Closing.

    Please bring the following to your Closing:

    1. A Survey.

    2. The Original Certificate of Occupancy.

    3. The Original Termite Letter, along with the Soil Treatment Guarantee/Report.

    4. Home Builders Warranty Information, if applicable.

    5. Keys and/or Garage Door Openers to the property.

    6. Copies of any relevant Corporate Documents showing who can sign at Closing.

    7. Photo Identification.
